Welcome to MAHALO Skin Care.

This website, including mahalo.care and all related pages, features, products, services, account areas, subscription features, content, emails, SMS messages, and online store functionality collectively referred to as the “Site,” is owned and operated by MAHALO Skin Care, referred to in these Terms as “MAHALO,” “we,” “us,” or “our.”

Please read these Terms of Use carefully before using the Site. By accessing the Site, creating an account, placing an order, purchasing a subscription, joining a rewards program, submitting content, or otherwise interacting with MAHALO, you agree to be bound by these Terms and by our Privacy Policy.

If you do not agree to these Terms, please do not use the Site.

1. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms.

You agree not to use the Site in any way that could damage, disable, overburden, impair, interfere with, or disrupt the Site or any other person’s use of the Site.

You may not attempt to gain unauthorized access to any part of the Site, customer accounts, systems, servers, payment processing systems, or networks connected to the Site.

We reserve the right to refuse service, cancel orders, suspend accounts, limit access, or terminate use of the Site if we believe these Terms have been violated or if activity appears fraudulent, abusive, unlawful, or harmful to MAHALO, our customers, or others.

You may not use the Site if you are prohibited from doing so by applicable law.

3. Account Registration and Security

You may be able to create an account to view order history, manage addresses, manage subscriptions, participate in rewards, or access other account features.

You agree to provide accurate, current, and complete information when creating or updating your account.

You are responsible for maintaining the confidentiality of your account login information and for all activity that occurs under your account. Please keep your password secure and do not share it with others.

We reserve the right to suspend or terminate accounts that contain inaccurate information, appear fraudulent, violate these Terms, or are used in a way that harms MAHALO or others.

4. Product Information

We make reasonable efforts to describe our products accurately, including ingredients, usage suggestions, sizes, benefits, images, pricing, and availability.

However, we do not guarantee that product descriptions, photographs, colors, textures, packaging, ingredient information, pricing, promotions, availability, or other Site content will always be complete, current, accurate, or error-free.

Product packaging, ingredients, fragrance, texture, color, and appearance may vary slightly from batch to batch due to the nature of botanical ingredients, natural materials, artisanal production, packaging updates, ingredient availability, or formulation improvements.

The appearance of products on your screen may vary depending on your device, display settings, lighting, and browser.

We reserve the right to update, modify, discontinue, limit, or reformulate products at any time without notice.

5. Cosmetic Disclaimer

MAHALO products are cosmetic products intended to support the appearance, feel, cleansing, moisturizing, conditioning, and care of the skin.

Our products and Site content are not intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition. Nothing on the Site should be understood as medical advice.

Information about ingredients, rituals, skin care, beauty, wellness, or product use is provided for general educational and informational purposes only.

Individual results vary. Skin is personal, and results may depend on many factors, including skin type, skin condition, age, environment, routine, sensitivity, consistency of use, and other products used.

If you have a medical condition, skin disease, allergy, pregnancy-related concern, medication interaction concern, or unusual skin reaction, consult a qualified healthcare professional before using any product.

Discontinue use if irritation occurs.

6. Allergies and Sensitivities

Please review product ingredient lists before purchasing or using MAHALO products.

Our products may contain plant oils, butters, essential oils, extracts, resins, honey, botanical actives, natural aromatic compounds, or other ingredients that may not be suitable for every person.

If you have allergies, sensitivities, reactive skin, or concerns about a specific ingredient, it is your responsibility to review the ingredients before use and consult a qualified professional if needed.

We recommend patch testing new products before full use.

MAHALO is not responsible for adverse reactions caused by allergies, sensitivities, misuse, incorrect product selection, or failure to review ingredients.

7. Orders

When you place an order, you agree that all information provided is accurate, complete, and current.

Your receipt of an order confirmation does not mean that we have accepted your order. We reserve the right to accept, decline, cancel, limit, or refuse any order for any reason, including suspected fraud, pricing errors, product availability, shipping limitations, payment issues, unusually high quantities, misuse of promotions, or violation of these Terms.

If we cancel an order after payment has been processed, we will issue a refund for the cancelled portion of the order.

We reserve the right to limit quantities purchased by any person, household, account, payment method, billing address, shipping address, or order.

8. Pricing and Availability

All prices are listed in U.S. dollars unless otherwise stated.

Prices, promotions, discounts, product availability, gifts with purchase, shipping offers, and other offers are subject to change at any time without notice.

We reserve the right to correct pricing, typographical, product, promotion, or availability errors at any time, including after an order has been submitted.

If a product is listed at an incorrect price or with incorrect information, we may cancel or refuse the order and notify you where appropriate.

Limited edition products, small-batch products, seasonal releases, gifts with purchase, and promotional items may be available only while supplies last.

9. Payment

By placing an order, you authorize our payment providers to charge your selected payment method for the total amount of your purchase, including product price, shipping, taxes, and any applicable fees.

Payment processing is handled by third-party payment providers. MAHALO does not store full credit card numbers on our servers.

You agree to provide accurate payment information and confirm that you are authorized to use the payment method provided.

If payment cannot be processed, your order may be delayed, cancelled, or declined.

10. Subscriptions and Automatic Renewals

MAHALO may offer subscription, replenishment, or recurring purchase options.

When you purchase a subscription, you agree to be charged automatically on a recurring basis according to the subscription frequency, price, product selection, shipping method, and terms presented at checkout and in your account.

By purchasing a subscription, you authorize MAHALO and its payment providers to charge your payment method automatically for each recurring order until you cancel, pause, or modify the subscription according to the options available to you.

Subscription prices, discounts, product availability, shipping costs, taxes, and terms may change over time. If required by law, we will provide notice before material changes take effect.

You are responsible for keeping your payment method, billing information, shipping address, and subscription preferences current.

If your payment method fails, we may retry the charge, contact you for updated payment information, pause the subscription, cancel the subscription, or take other steps available through our subscription system.

You may cancel or manage your subscription through your account where available, or by contacting us at contact@mahalo.care.

If you enrolled online, you must be able to cancel online where required by applicable law.

To avoid being charged for an upcoming renewal, cancellation or changes must be completed before the renewal order is processed. Once a renewal order has processed, it may not be possible to cancel or change that shipment.

Subscription discounts, gifts, benefits, or promotional pricing may be limited to active subscriptions and may change or end at any time unless otherwise stated.

11. Rewards, Credits, Gifts, and Promotions

MAHALO may offer rewards, loyalty points, credits, referral benefits, gifts with purchase, discount codes, limited-time offers, bundles, or other promotions.

Promotions are subject to the terms stated with the offer and may be changed, limited, or discontinued at any time.

Unless otherwise stated, promotions cannot be combined, applied retroactively, transferred, redeemed for cash, or used on past purchases.

Rewards, credits, or promotional benefits have no cash value unless expressly stated.

We reserve the right to cancel, revoke, or refuse rewards, credits, promotions, gifts, or discounts if we believe they were obtained through error, fraud, abuse, duplicate accounts, unauthorized resale, or violation of these Terms.

Gifts with purchase are available only while supplies last and may not be exchanged, returned for cash, or replaced if unavailable.

If a return, refund, or credit is ever approved for an order that included a gift with purchase, the gift may need to be returned unused and unopened, or the value of the gift may be deducted from any refund or credit.

12. Shipping and Delivery

Shipping options, costs, timeframes, and carriers may vary depending on your location, order size, product availability, and shipping method selected at checkout.

Shipping estimates are estimates only and are not guaranteed.

Once an order is transferred to a shipping carrier, delivery timing and handling are largely outside of MAHALO’s control.

MAHALO is not responsible for delays caused by carriers, weather, customs, incorrect addresses, theft, refused packages, failed delivery attempts, holiday volume, natural disasters, or events beyond our reasonable control.

You are responsible for providing a complete and accurate shipping address at checkout.

If a package is returned to us due to an incorrect address, refused delivery, failure to claim, or other customer-related delivery issue, additional shipping charges may apply.

Risk of loss may pass to you when the order is delivered to the shipping address provided or otherwise marked as delivered by the carrier.

If your package is marked delivered but you cannot locate it, please check with household members, neighbors, building management, parcel lockers, and the shipping carrier. Contact us promptly if further support is needed.

13. International Orders

If international shipping is available, international customers are responsible for all duties, taxes, customs charges, import fees, brokerage fees, and any other charges imposed by the destination country.

MAHALO is not responsible for delays, seizures, restrictions, returned packages, or additional charges caused by customs or import regulations.

You are responsible for confirming that products ordered from MAHALO may lawfully be imported into your country.

14. Returns, Exchanges, Damages, and Final Sale Items

Due to the personal nature of skin care, MAHALO does not accept returns or exchanges of opened, used, sampled, or otherwise handled products unless required by law or expressly approved by us.

We do not offer returns or exchanges for general dissatisfaction, scent preference, texture preference, change of mind, incorrect product selection, personal sensitivity, allergy, or reaction unless otherwise required by law.

Please review product descriptions and ingredients carefully before ordering. If you need help choosing a product, contact us before placing your order.

Certain items are final sale, including opened products, used products, samples, limited edition items, gifts with purchase, promotional items, sale items, discontinued items, and products purchased from third-party retailers unless otherwise stated.

If your order arrives damaged, defective, leaking, or incorrect, contact us promptly at contact@mahalo.care with your order number, a description of the issue, and clear photos of the product, packaging, and shipping box.

We may offer a replacement, store credit, refund, or other resolution at our discretion, depending on the circumstances and applicable law.

Products purchased from third-party retailers must be handled through the retailer where the product was purchased.

Wholesale, professional, discounted, promotional, or custom orders may be subject to separate terms.

15. Order Changes and Cancellations

We begin processing orders as quickly as possible.

If you need to change or cancel an order, contact us promptly at contact@mahalo.care. We cannot guarantee that changes or cancellations can be made once an order has entered processing, fulfillment, or shipment.

Once an order has shipped, it cannot be cancelled.

16. Reviews, Testimonials, and User Submissions

You may have the opportunity to submit product reviews, testimonials, photographs, comments, feedback, survey responses, social media content, or other materials collectively referred to as “User Content.”

By submitting User Content to MAHALO, you represent that the content is truthful, based on your actual experience, does not violate the rights of others, and does not contain false, misleading, unlawful, obscene, threatening, abusive, defamatory, or infringing material.

You agree not to submit fake reviews, reviews based on someone else’s experience, reviews generated without actual product use, reviews in exchange for undisclosed compensation, or content that misrepresents your relationship with MAHALO.

If you received a product for free, received compensation, have a material connection to MAHALO, or received any incentive in connection with a review or testimonial, you must disclose that clearly.

By submitting User Content, you grant MAHALO a worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, reproduce, edit, publish, translate, display, distribute, adapt, and create derivative works from that content in any media, including the Site, email, social media, advertising, and other marketing materials.

We may edit User Content for length, clarity, grammar, formatting, or moderation, but we will not knowingly alter the meaning of your experience.

We may refuse, remove, or moderate User Content at our discretion.

Submitting ideas, suggestions, feedback, or other materials to MAHALO does not create any obligation for us to compensate you, credit you, keep the submission confidential, or use the submission.

17. Intellectual Property

The Site and its content are owned by MAHALO or used with permission.

This includes product names, product descriptions, formulas, text, photographs, videos, graphics, logos, designs, icons, page layouts, artwork, brand language, rituals, packaging, images, and other content.

All content is protected by copyright, trademark, trade dress, and other intellectual property laws.

You may view and use the Site for personal, non-commercial purposes only.

You may not copy, reproduce, modify, distribute, display, sell, resell, exploit, scrape, frame, republish, upload, transmit, create derivative works from, or otherwise use any Site content without our prior written permission.

18. Trademarks

MAHALO Skin Care, MAHALO, product names, logos, slogans, graphics, and other brand identifiers are trademarks, trade names, or trade dress of MAHALO.

You may not use MAHALO trademarks, product names, logos, trade dress, or confusingly similar marks without our prior written permission.

19. Third-Party Links and Tools

The Site may contain links to third-party websites, services, platforms, tools, payment providers, social media platforms, shipping providers, or other resources.

These links are provided for convenience only.

MAHALO does not control and is not responsible for third-party websites, services, content, policies, privacy practices, availability, security, or actions.

Your use of third-party websites or services is at your own risk and may be governed by the terms and policies of those third parties.

20. Prohibited Uses

You agree not to use the Site or any MAHALO content:

For unlawful, fraudulent, abusive, or misleading purposes
To violate any law, regulation, or third-party right
To infringe intellectual property rights
To submit false, misleading, or fraudulent information
To place unauthorized, fraudulent, or resale orders
To interfere with Site security or operation
To scrape, harvest, or collect information from the Site
To transmit viruses, malware, spam, or harmful code
To impersonate another person or entity
To harass, threaten, abuse, defame, or harm others
To manipulate reviews, promotions, rewards, referrals, subscriptions, or discounts
To resell products without written authorization from MAHALO
To engage in any activity that harms MAHALO, our customers, or the integrity of the Site

We reserve the right to investigate and take appropriate action, including cancelling orders, refusing service, suspending accounts, revoking rewards, blocking access, or pursuing legal remedies.

21. Unauthorized Resale

MAHALO products are intended for personal use and authorized retail sale only.

You may not purchase MAHALO products for unauthorized resale, marketplace resale, diversion, relabeling, repackaging, export, or distribution without our prior written consent.

We reserve the right to cancel or limit orders that appear to be placed for unauthorized resale or diversion.

Products purchased from unauthorized sellers may be expired, altered, damaged, improperly stored, counterfeit, or otherwise outside our quality control. MAHALO is not responsible for products purchased from unauthorized sellers.

22. Disclaimer of Warranties

The Site, its content, and all products and services are provided on an “as is” and “as available” basis, unless otherwise expressly stated.

To the fullest extent permitted by law, MAHALO disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, uninterrupted operation, and error-free performance.

We do not guarantee that the Site will always be secure, available, uninterrupted, current, accurate, or free of viruses or harmful components.

Some jurisdictions do not allow the exclusion of certain warranties, so some exclusions may not apply to you.

23. Limitation of Liability

To the fullest extent permitted by law, MAHALO and its owners, employees, contractors, service providers, suppliers, partners, and affiliates will not be liable for any indirect, incidental, special, consequential, punitive, exemplary, or similar damages arising from or related to your use of the Site, products, services, content, orders, shipping, subscriptions, promotions, or these Terms.

This includes damages for lost profits, lost revenue, lost data, business interruption, personal dissatisfaction, adverse reactions, shipping delays, unauthorized account access, or inability to use the Site.

To the fullest extent permitted by law, MAHALO’s total liability for any claim related to an order will not exceed the amount you paid for the product or service giving rise to the claim.

Nothing in these Terms limits liability where liability cannot be limited under applicable law.

24. Indemnification

You agree to defend, indemnify, and hold harmless MAHALO and its owners, employees, contractors, service providers, suppliers, partners, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

Your use of the Site
Your violation of these Terms
Your violation of any law or third-party right
Your User Content
Your misuse of products
Your fraudulent, abusive, or unauthorized activity
Your unauthorized resale or distribution of MAHALO products

25. Force Majeure

MAHALO will not be responsible for delays, failure to perform, or inability to fulfill obligations caused by events beyond our reasonable control.

This may include natural disasters, severe weather, fire, flood, pandemic, labor disruption, carrier delays, customs delays, supply shortages, ingredient shortages, packaging shortages, power outages, technical failures, cyber incidents, war, terrorism, civil unrest, government action, or other events outside our control.

26. Governing Law

These Terms and any dispute arising from or related to the Site, products, services, orders, subscriptions, or MAHALO will be governed by the laws of the State of Hawaii, without regard to conflict of law principles.

You agree that any legal action or proceeding related to these Terms or MAHALO will be brought in the state or federal courts located in Hawaii, unless applicable law requires otherwise.

27. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in full force and effect.

28. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision in the future.

29. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the “Last Updated” date at the top of this page.

Your continued use of the Site after updated Terms are posted means you accept the updated Terms.
